    No, Hoverboards Aren't "Illegal" In New York City

    But that doesn’t mean you can ride them on the street.

    On Monday, the NYPD's 26th precinct, which covers Morningside Heights and parts of West Harlem, tweeted that hoverboards, the self-balancing scooters that have taken over the world, are illegal:



    Over the past two days, the tweet solicited dozens of responses, mainly pointing to exceptions within the administrative code cited in the tweet. To wit:
    "For the purposes of this section, the term motorized scooter shall not include wheelchairs or other mobility aids designed for use by disabled persons, electric powered devices not capable of exceeding fifteen miles per hour or "electric personal assistive mobility devices" defined as self-balancing, two non-tandem wheeled devices designed to transport one person by means of an electric propulsion system"
    Hoverboards, at least the ones that have come to the U.S. thus far (they're all manufactured in China), cannot exceed 15 mph. Most of them cannot exceed 8 mph. Furthermore, hoverboards, which operate with two independent self-balancing wheels, fit the very description of "electric personal assistive mobility devices," meaning they are further excepted from this administrative code.
    And as of noon today, the 26th precinct had removed the tweet.

    Jawbone Just Laid Off 60 Employees And Shut Down Its NY Office




    Five months after laying off 4% of its workforce, Jawbone is swinging the axe once again. On Thursday, the fitness tracker manufacturer sacked 60 employees - 15% of its workforce — and shuttered its New York offices.
    The layoffs are company wide and weren't focused on a particular department, though Jawbone's New York office was largely dedicated to marketing.

    "Jawbone's success over the past 15 years has been rooted in its ability to evolve and grow dynamically in a rapidly scaling marketplace," Jawbone said in a statement provided to BuzzFeed News. "As part of our strategy to create a more streamlined and successful company, we have made the difficult decision to reorganize the company which has had an impact on our global workforce. We are sad to see colleagues go, but we know that these changes, while difficult for those impacted, will set us up for greater success."

    Jawbone, whose June layoffs came just weeks after the company raised $300 million in new financing, is currently battling a patent infringement suit from rival Fitibit and struggling amid increasingly brutal competition in the wearable market. According to an August IDC report on wearables, the the top five wearable vendors based on shipment volume and marketshare were Fitbit, Apple, Xiaomi, Garmin, and Samsung - Jawbone didn't make the cut.

    SpaceX To Ferry NASA Astronauts To International Space Station

    The California company is the second private firm to win a bid for one of four orders to take American astronauts to the International Space Station aboard its Crew Dragon spacecraft. Boeing won the first such order in May but NASA has not yet decided which company will run the first flight.

    NASA has not had the ability to send humans into space on its own since the end of the Space Shuttle program in 2011. The program, which lasted for more than 30 years and launched 135 flights, was extended far past its intended duration of 15 years. Since its end, NASA has had to rely on Russian spacecrafts to take its astronauts to space.

    "This was probably the best light I was able to photograph during my recent trip to Iceland. While the Vestrahorn Mountains are pretty cool in their own right, I was really attracted to the dune formations, black sands, and the grasses backlit by the rising sun. It was difficult to find compositions with untrampled sand, as the area is well visited by both serious photographers and the casual selfie crowd! Bad weather allowed me to enjoy the area pretty much to myself and witness a beautiful light show. I need 3 images to control the flare and intense lighting, which I hand blended. The first image was taken just prior to the sun breaking through a slice in the clouds, the second when the sun broke through the cloud opening, and a third with my finger obscuring the sun in the opening. This was needed to preserve proper contrast in the grasses and sand without flare artifacts and still include the sun in the image. Unusually still winds enabled me to easily blend these 3 images to better represent the magical moments. The image still doesn't do the scene justice, it was just breathtaking to witness."

    Startup Zenefits Under Scrutiny For Flouting Insurance Laws

    The Silicon Valley startup Zenefits, valued at $4.5 billion in a funding round earlier this year, apparently flouted insurance laws by allowing unlicensed brokers to sell health insurance - an approach that has led to at least one regulatory inquiry into the legality of its operations.

    Zenefits, a middleman in the health insurance business, has repeatedly failed to enforce legal requirements that anyone selling a health insurance policy have an appropriate state license, a BuzzFeed News investigation has found. The San Francisco-based company allowed numerous salespeople to act as insurance brokers in at least seven states without licenses to do so, according to internal emails and records, as well as interviews with eight former employees with direct knowledge of the matter.

    BuzzFeed News has reviewed examples of the unlicensed sale of insurance by Zenefits employees dating back as far as the summer of 2014 and continuing through this summer. It is unclear when the practice began and whether it continues today; the company says it now has strict procedures in place to enforce licensing rules.

    At least one regulator, the insurance commissioner in Washington state, is currently examining whether Zenefits operated there without licenses, according to a spokesperson for the agency, Stephanie Marquis. The Washington inquiry began in early 2015 and has not yet been resolved, she said.

    Zenefits management seemed aware of the potentially serious consequences of violating licensing rules. Under Washington law, anyone who knowingly sells, solicits, or negotiates insurance without the proper state license is guilty of a Class B felony, which can carry a prison sentence of up to 10 years, as well as a civil penalty of up to $25,000 for each violation.

    The email, and two follow-up notes, were sent on a Thursday. On the following Monday, 22 Zenefits employees became licensed brokers in Washington, state records show. Four others received their Washington licenses later that month.

    While Zenefits sales reps were told that they needed licenses to do their job, managers in many cases showed a blase attitude toward the requirement, pushing the unlicensed reps to meet sales quotas, the former employees said. In several cases, sales reps who had failed a broker license exam once or more times were allowed to continue working the phones. At least one person who lacked any license in any state but hit his sales quotas last fall was promoted, according to state records and former employees.

    Zenefits gives away free software to small businesses to manage their employee benefits, though fundamentally it is an insurance brokerage firm, collecting recurring commissions when it sells health insurance policies to those businesses. It says its technology and user-friendliness can help it displace stodgy insurance brokers and claim their lucrative commissions.

    Judge Slams Crackdown On Backpage.com As "Lawless Government Coercion"

    A federal judge has ruled that efforts by the Cook County Sheriff to crack down on adult classifieds site Backpage.com were unconstitutional, ordering the Sheriff to cease pressuring credit card companies to cut their links to the controversial site.

    In a strongly worded opinion released on Monday, Judge Richard Posner of the Seventh Circuit Court of Appeals ruled that Sheriff Thomas Dart was prohibited from using his office to pressure service providers not to work with Backpage.com. In November, the court issued an injunction against Dart.

    That injunction was issued again Monday. Dart is also required to notify Visa and MasterCard as well as the Postal Service of the order.

    Google Accused Of Violating Student Privacy In FTC Complaint



    A leading activist group has accused Google of violating students' privacy in its suite of education apps and on its Chromebook laptops, which are now the most popular devices in American classrooms.

    The Electronic Frontier Foundation (EFF) filed a complaint yesterday with the Federal Trade Commission saying that Google is violating a student privacy pledge it signed in January, in which it promised not to collect, store, or use students' data except for educational purposes.

    The privacy pledge that is being wielded against Google was has been signed by more than two hundred companies, including Microsoft, Apple, and Blackboard. The FTC's ruling on how Google handles students' information could set the stage for similar complaints against other major industry players.

    The EFF's complaint alleges that when students are signed into Google's education accounts, data from their non-educational activities is used by Google for business purposes. While data from "Apps for Education" like search and Google Drive is kept only for educational purposes, information gleaned from usage of apps like Google Maps and Youtube is analyzed to help serve up targeted advertising.

    Jeremy Gillula, a staff technologist with the EFF, called that data collection an "invasion of privacy" and a clear violation of the privacy pledge.

    In a statement, a Google spokesperson said that, "While we appreciate EFF's focus on student privacy, we are confident that these tools comply with both the law and our promises, including the Student Privacy Pledge."

    The data privacy pledge was created in October of 2014 after a parent-led furor over student privacy essentially drove one nonprofit, called InBloom, out of business. Google initially didn't sign on, but eventually added its name in January.

    "We are committed to ensuring that K-12 student personal information is not used to target ads in these services, and in some cases we show no ads at all," he wrote.

    You're back home with nothing to do, and all your childhood friends (or, as The Onion puts it, "every smug and unlikable asshole [you] ever went to high school with") are hitting the bars. Thanks to Square, we now have the receipts.

    Square, which processes credit card payments, gathered payment data from the bars that use its service.



    According to Square, people drink a lot more on the night before Thanksgiving, when compared to the week before that.
